The Nonresident Crew Exceptions Program establishes a flat 15% credit on a specified number of nonresident *industry crew (for wages, benefits and per diem) for a limited number of positions based on the project’s *New Mexico budget.
*Industry crew means a person in a position that is off-camera and who provides technical services during the physical production of a film and does not include a writer, director, producer, background artist or performing artist.
*New Mexico budget refers to the budget for services in NM regardless if they qualify for the incentive.
No exceptions will be made for the following positions that are filled by nonresidents who are employed, contracted directly or subcontracted by the Production:
- Associate Producer
- Executive Producer
- Line Producer
- Director of Photography
- Production Designer
- Costume Designer
- Still Photographer
- Motion Picture Driver (whose sole responsibility is driving)
ALLOWABLE NUMBER OF POSITIONS (Based on NM Budget)
Up to 10 additional positions may be permitted if five or more productions are being produced in NM at the same time as your production.
No more than 40 positions will be allowed for any given project.
*In certain instances, a standalone pilot intended for series in New Mexico is authorized for 8 additional nonresident crew positions.
